Welcome to DIYProducts.com.au (“DIY Products,” “Company,” “we,” “our,” or “us”). These Terms of Service (“Terms,” “Agreement”) form a legally binding contract between you (“you,” “your,” “Customer,” or “User”) and DIY Products. They govern all access to and use of our website and its subdomains, our e-commerce platform, content, and related digital applications, and any goods or services that we supply (collectively, the “Services”). By visiting or using our Services, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and by our incorporated policies including our Privacy Policy, Shipping Policy, and Refund & Returns Policy. If you do not accept every part of these Terms, you must immediately stop using the Services.

You warrant that you are at least eighteen years old (or the age of majority in your jurisdiction) and have full legal capacity to enter into binding contracts. If you use the Services on behalf of a company, trust, partnership or other entity, you represent and warrant that you have full authority to bind that entity and that neither you nor the entity is subject to any applicable trade sanctions or restricted party prohibitions. Your continued use of the Services constitutes acceptance of these Terms, including any updated version. We may revise these Terms at any time by posting the amended version with a new “Last Updated” date, and you waive any right to receive specific notice of each change.

The Services are powered by the Shopify e-commerce platform and may include other third-party tools (such as payment gateways and app integrations). DIY Products controls the supply of its goods and the content it posts, but Shopify Inc. is solely responsible for the operation, security and uptime of the Shopify platform itself, including hosting, data storage and the transmission of payment details through Shopify’s secure checkout. To the extent that any fault or failure is caused by Shopify’s platform or other third-party services that we do not control, those providers remain responsible for their own systems and legal obligations. Nothing in these Terms limits your statutory rights or those third parties’ separate duties to you under applicable law.

You may create an account to streamline ordering and track purchases. You agree to provide true, current and complete information and to keep your login credentials secure. You accept full responsibility for all activity on your account and will promptly notify us of any unauthorised use. We are not liable for losses arising from your failure to safeguard your credentials. We may suspend, restrict or close an account without notice if we suspect fraud, breach of these Terms, or prolonged inactivity.

An order you place constitutes an offer to buy; a contract forms only when we issue an order-confirmation email. We may accept, reject or cancel any order at our sole discretion and without liability, even after confirmation, if stock is unavailable, an error has occurred, or we suspect fraud. All prices are in Australian dollars (AUD) and include GST where applicable. We may change prices, promotions or availability without notice until we accept an order. Payment in full is required at checkout through our approved payment methods, and you authorise us and our payment processors to charge all amounts due, including shipping and taxes. You are solely responsible for any currency-conversion fees, bank charges or delays caused by your payment provider. Payment processing is handled through Shopify Payments or other nominated gateways, which are directly responsible for securely transmitting and protecting your payment information.

All product images and descriptions are for illustrative purposes. Reasonable manufacturing tolerances and natural variations mean colours, patterns, grains, finishes and dimensions may differ slightly from photographs. Such variations do not constitute defects. We take reasonable care to present accurate information but do not guarantee the site is error-free and may correct errors or omissions at any time, including after you place an order.

Orders are usually processed within two to four business days, excluding weekends and public holidays, and delivered within Australia via reputable couriers. Delivery times are estimates only and are not guaranteed. Risk of loss or damage passes to you once the order is handed to the carrier. You must provide complete and accurate delivery details. We are not responsible for delayed or lost shipments caused by incorrect addresses or by events outside our reasonable control.

Our Refund & Returns Policy is incorporated into these Terms. Except as required by the Australian Consumer Law (ACL), we do not accept returns or offer refunds for change of mind or incorrect choice. If goods are defective or damaged on arrival, you must notify us in writing within seven days of receipt, providing clear photos and your order number. Where the ACL applies, our goods come with non-excludable guarantees. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the goods repaired or replaced.

You must use the Services only for lawful purposes and in a way that does not infringe the rights of others or interfere with anyone else’s use. You must not attempt to gain unauthorised access to our systems, introduce malicious code, harvest data or disrupt the security or operation of the Services. We may suspend or terminate your access without notice if we believe you have breached these rules.

All intellectual property in the Services—including text, graphics, designs, photographs, videos, logos, trademarks and software—is owned by or licensed to DIY Products and protected by copyright, trademark and other laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial purposes. You may not copy, distribute, create derivative works from, publicly display, or exploit our content without our prior written consent.

Our Services may link to third-party websites or services. These links are provided only for convenience and do not imply endorsement. We have no control over third-party content and accept no responsibility for it. Your dealings with third parties are solely between you and those parties. Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information.

Except for non-excludable guarantees under the ACL, the Services and all goods are provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, we exclude all implied warranties including merchantability, fitness for a particular purpose and non-infringement, and we do not guarantee that the Services will be uninterrupted, timely, secure or error-free. To the fullest extent permitted by law, DIY Products and its officers, employees, contractors and agents will not be liable for indirect, incidental, special, consequential, punitive or exemplary damages (including loss of profits, revenue, goodwill, data or anticipated savings), even if advised of the possibility of such damages. However, nothing in these Terms limits Shopify’s separate obligations to you under its own terms of service, privacy policy or the Australian Consumer Law, and any platform-level failure or data breach that is solely within Shopify’s control remains Shopify’s responsibility. Where liability cannot be excluded under the ACL, it is limited, at our option, to repairing or replacing the goods, supplying equivalent goods, or paying the cost of doing so. Our total liability to you for any claim will not exceed the price you paid for the goods or services giving rise to the claim.

You agree to indemnify, defend and hold harmless DIY Products, its affiliates, officers, employees, contractors and agents from and against any and all claims, demands, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising from or related to your use or misuse of the Services or our products, your breach of these Terms, or your violation of any law or third-party rights. This indemnity survives the termination or expiry of these Terms. We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, pandemics, government actions, labour disputes, transport failures or internet outages.

These Terms are governed by the laws of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria and agree to attempt in good faith to resolve disputes through negotiation or mediation before commencing legal proceedings. We may suspend or terminate your account or access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms or if required by law. Termination does not affect any rights or obligations accrued prior to termination. If any provision is found invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, Refund & Returns Policy and Shipping Policy, are the entire agreement between you and DIY Products and supersede all prior representations, agreements or understandings.

All notices to DIY Products must be in writing and delivered by email or post to DIY Products, ABN 59690288101, email support@DIYproducts.com.au. By using the Services, you acknowledge that you have read and understood these Terms and accept them in full.
